He was predeceased by : his father David Lumpkin Payne, Sr.. He is survived by : his wife Betsy Hunt Payne of Jefferson; his children, Marilyn Payne Smith of Chattanooga and Joe Stewart Payne, Jr. of Atlanta; and his grandchildren, Ashley Renee Payne of Decatur, Christian Summer Smith, Hunter Robin Smith and Nicholas Sean Smith of Chattanooga. He is also survived by twenty nieces and nephews.
