He was predeceased by: his mother Gladys Lay; his sons, Timothy E. Lay and James "Rick" Lay; his grandsons, Timothy E. Lay II and Shane M. Lay; his siblings, Elmose "Bobby" Lay, Charles Lay and Ruth "Gail" Ellsworth; and his father Marlin L. Lay.

He is survived by: his wife Charlotte M. Lay of Elkhart; his children, Tom D. Lay (Ginny) of Elkhart and Constance J. Flamion (Lay) of Mishawaka; his sisters, Louise Fisher of South Bend, IN and Patricia "Ann" Wallace of Elkhart; and his grandchildren, Angela Flamion (Joshua Hullinger), Phillip J. Flamion II (Katie), Alexandra Hershberger (Kyle), Trinity, Amanda Lay, Ricky, Matthew Lay, Nathan and Tieler Littlepage. He is also survived by 13 great-grandchildren and 1 great-great-grandchild.
