He was predeceased by: his parents, Melvin Bud and Laura Lau Payton (Hudson); and his brother Jerry Payton. He is survived by: his wife Linda S. Payton; his sons, James R. Payton Jr. of Marengo, Buddy L. Payton (Savannah) of English, D. J. Davis of Mitchell and Rusty Deweese of Lawrenceville, Illinois; his sister Melva Grimes of Paoli, Indiana; and his grandchildren, Rodney Payton, Kaydence and Luke Robbins.
