He was predeceased by : his wife Treva Ogburn Spivey; his parents, Marvin Lafayette Spivey and Margie Pollard Spivey; and his siblings, Daisy Currin, Mary Ann Wortham and Clinton Spivey.

He is survived by : his children, Michele Tobey (Bob) of Leland, Mickey Spivey (Karen) of Raleigh and Marty Spivey (Annette) of Coats; his siblings, Bobbie Rhodes of Fuquay-Varina and Glenn Spivey (Helen) of Fuquay-Varina; his sister-in-law Debra Spivey of Raleigh; his grandchildren, Kristie Spivey of Coats, Robin Spivey of Coats, Josh Tobey (Ramsey) of Wilmington, Matt Spivey (Holly) of Winston-Salem and Leigh Spivey-Rita (Jen) of Durham; and his great grandchildren, Noa, Maggie, Elliott, Rowan, Everett and Miller.
