He was predeceased by: his parents, Louis Capak and Ruby Capak; his wife Edith Capak; his brother William Ray Capak; and his daughter Connie Sue Capak.

He is survived by: his daughter Shanna Harris (Cree); his grandchildren, Derek Lopez, Danielle Lopez, Caroline, Ervin Simmons and Hailee Lopez; his great grandchildren, Aliyah and Mason Simmons; and his stepchildren, Scott Becker, Sheila Fikes and Annette Kolterman.
