He was predeceased by: his parents, Maddin Callender Spivey and Lillie Spivey (Henington); his wife Josephine Bartlett (Treadwell); his siblings, Christine Spivey Birge, James Sherwood Spivey and Marshall Spivey; and his great grandchild Noah Spivey.

He is survived by: his friend Dr. W. D. Thames; his children, David Maddin Spivey of Houston, Mark Alan Spivey of Plano and Janet Spivey Bemenderfer of Plano, Texas.; his children-in-law, Judy Connelly Spivey of Plano and Fred Bemenderfer of Plano; his grandchildren, Sarah Spivey Little (Travis Little) of Farmers Branch, Texas, John Spivey (Christine), Daniel Bemenderfer of Plano, Brian Spivey (Michelle) of Irvine, John Bemenderfer (Emily) of Farmers Branch and Alan Bemenderfer (Melissa) of Murphy, Texas.; and his great grandchildren, Lisa of Raleigh, Brooke of Raleigh, Tim Spivey of Raleigh, Evelyn Bemenderfer of Farmers Branch, Lauryn, Lucas Bemenderfer of Murphy and Anne Little of Farmers Branch, Texas..
