He was predeceased by: his parents, Delores Reyes and Daniel Garcia Rubio; and his sister Fannie Hernandez. He is survived by: his wife Delia "Dee" Rubio; his sons, Daniel R. Rubio, III (Shelia) and Robert J. Rubio (Mandy) of Driftwood; his grandchild Christian T. Rubio (Lainy) of Sour Lake; his children, Gavin N. Rubio of Sour Lake and Ellie J. Rubio of Driftwood; and his sister Rosie Ann Garcia (Alfred) of Beaumont.
